    Thumbs up Licensing Laws : New York State

    I have found a few good pointers from the NYC web site and others within NYS I will post them under the understanding if they get upgraded or taken down it is up to you to continue the search any other information on the site is not my responsibility.

    Here is some very good information once you may have started.
    TRESPASS; PRIVILEGED ENTRY; PROCESS SERVERS

    There seem to be only a few process servers in NYS & NYC.

    About Service of Process

    Who can a Service of Process be served against?

    Ans: A Service of Process may be served against any insurance company licensed in New York State (pursuant to Section 1212 of the Insurance Law), an unlicensed insurance company (pursuant to Section 1213 of the Insurance Law), a Federal Risk Retention Group (Section 5904) or a non-resident agent or broker, for an action taking place in a Court located in New York State.

    The New York State Insurance Department does not accept Service of Process against Motor Vehicle Accident Indemnity Corporation, the State Insurance Fund, resident agents and brokers, or Health Maintenance Organizations.

    What county is designated for the court of venue?

    Ans: The court of venue may be in any county located in New York State.

    How can a Summons or Service of Process be served?

    Ans: A Service of Process may be served:

    in person: to the Office of General Counsel in the New York City Office of the New York State Insurance Department, 25 Beaver Street, New York, NY 10004, or the Corporate Affairs Unit in the Albany Office, One Commerce Plaza, Albany, NY 12257.

    by mail: New York State Insurance Department, Corporate Affairs Unit, One Commerce Plaza, Albany, NY 12257.

    What is needed to serve a Summons or Service of Process?

    Ans: If action is taking place in a court located in New York State and if it against a licensed insurance company, Risk Retention or Purchasing Group, or a non-resident agent or broker, send one copy and a $20.00 check made payable to the Superintendent of Insurance.

    If action is taking place in a court located in New York State and it is against an insurance company not licensed in New York State, it will be accepted pursuant to Section 1213 of the Insurance Law; send 2 copies of the Service of Process, provide us with the last known principal address of the company and a $20 check made payable to the Superintendent of Insurance.

    How do I find out whether or not an insurance company is licensed in New York State?

    Ans: To find out whether the company is licensed in New York State or whether the Risk Retention or Purchasing Group is registered with the New York State Insurance Department, you may go to our Directory of Regulated Insurance Companies on this Web site.

    What is the effective date of service?

    Ans: The effective date of service is the date the papers are received by the New York State Insurance Department in Albany, NY or New York, NY.

    Does a separate check have to be submitted for each Service of Process?

    Ans: No. We will accept one check for multiple companies being served - $20.00 per service; however, if one action in the group in unacceptable, all the services will be returned.
