    "Who is Eligible for Social Security Disability?

    "If you work long enough at a job, which is covered under the provisions of the Social Security Act, and become disabled, you are probably eligible for Social Security Disability benefits.

    "According to the Social Security Administration, a "disability" can be:
    1. physical,
    2. emotional,
    3. or some combination of both.

    "In order to win benefits, you must have a disability severe enough to keep you from working in any regular paying job for at least 12 consecutive months.

    • The test for eligibility for Social Security Disability benefits is not whether you can go back to a job you have lost. It is not whether you have been able to find a job recently.

    Filing a Social Security Disability Claim

    "The government makes the process very difficult. Waiting lines are long. Forms are complicated. Social Security Disability Benefits are often denied to people who have legitimate Disability claims. As a result, many people who apply for Social Security Disability Benefits on their own become discouraged and intimidated, so they simply back off, give up, and go away even when they are genuinely entitled to their Social Security Disability benefits. But Advocates do not let the government intimidate their clients. They are always active, aggressive advocates for their clients. It is a tough job, but they have been doing it for a long time. They are good at it and proud of the fact that they win such a high percentage of cases.

    Advocates combine the strength and focus of their national organization, with the personalization and attention to detail that comes from having a permanent presence in each community that they serve.

    How are Advocates paid?
    Their fees are usually 25% of the past-due benefits but are only paid if they are successful. In most cases, their fees are capped at $5300. The cap is set by the Commissioner and is always subject to change.

    From what I have seen with my mom the system is pretty tough these days. It is sad to see those who abuse the system make it tough for those who need it.
