Jim, that is an excellent web source. I don't have the time right now to experiment with the root website, which appears to be a government website on statutes. But if you have the time I would like to know of other state regs on Process Servers that we could replace with more clear and direct links.

As an example:

It may require:

Glad you enjoyed the link. I checked out Alabama Code (What they call Alabama Statutes) and found a source, as follows:

It should be noted that the codes state that generally, Alabama process should be served according to the Alabama Rules Of Civil Procedure. One link I found for the Alabama Rules Of Civil Procedure regarding service of process is as follows:

By the way I am working on the florida link. It seems all of the government statute sites have been down for a while. I'm trying to find links to the info in college and university sites for the state now! I'll reply here when I get it fixed.

Florida's working again.

I try to use only official government and collegiate sites as much as possible because the information is more reliable. However, the sites themselves are not as laws are consistantly changing, they must keep up with them on the websites.

Ok here’s the break down in Oklahoma to become a Licensed Process Server.

For a County the fee is 15 dollars, but filing fees and mailing cost bring that up to 147 dollars. That’s for 1 year.

For Statewide process severing its 262 dollars for 1 year.

Also you have to get a Bond on yourself for 5000, which after checking around is about 50 dollars.

So for about 200 dollars you can become a Licensed Process Server in Oklahoma.

BTW (by the way) the clerk I talked to said it had become quite a cutthroat business in Oklahoma. But one that will become very profitable if you’re persistent, and willing to get your own contacts for business.

You're welcome. I understand what you mean as far as being able to understand the laws. It almost as if they were written in another language sometimes. I just keep rereading them and looking up words that I don't understand and going back until they are clear.

Hello, I am new with IPIU and the process server sounds like something I would most definitely like to do. Your list is fabulous but I am haveing trouble with the New Jersey link...error "Fatal error: Unable to open C:\Inetpub\wwwroot\serve\states\nj.php3 in Unknown on line 0" and I live in New Jersey. Just to let everyone know that the Law in Tennessee has change on Process Serving. I was told that in July they changed it. Basicly you can have anyone that is not involved with your case, serve the papers. :p

I added the "rule 4" as a convenience for everyone because the link that I provided is a link to the whole “Rules of Civil Procedure” of that particular state.

I have found that most states’ Rules of Civil Procedure has rule 4 pertaining to the rules of process serving.

My advice is to check out the county courthouse. They should be able to tell you what to do. And/or check your state's homepage for state law. Here in WA it is very simple: fill out registration, pay $10, get business license. That is pretty much it. But be sure you know what to do (to find people who do not want to be served), and what constitutes legal service of a document. These rules vary state to state.

The reference book is a great idea. The information overload on process serving requires documenting so you do not forget the smaller details. This also allows you to help others, as well. Thanks for the tip! :D

Elizabeth, the first place I'd check would be with the Circuit Court Clerks office. They can tell you whether they use independent process servers or use the Sheriff's dept... if you get someone REAL helpful, they can give you some ideas of local Law firms that might be using some too!

If you look in the job openings forum there is an agency here in Maryland that frequently has job openings for process servers. I reponded to their ad and have been working part time as a sub-contractor for a while now. I did not have previous experience at the time, but I applied anyways. I sent them an e-mail and within a week I started working for them.

David, They have been keeping me quite busy. I am sure if I wanted to do this full time, there would be plenty of work. I work full time at another job, so I do most of my serves on the weekends and a few during the week. I have run into quite a variety of people. Most of the serves go quite well and people have been pretty decent. It seems the ones that become arrogant or nasty, have been people employed in the professional field.

Sometimes it is difficult trying to juggle both jobs because my full time job is one hour away from home and many nights I do not get home until 8:00 p.m.
This is one of the reasons I only do serves in my county. Also, there are many times I may have to go back to an address 3 or 4 times. If I did not limit my area to my county, I would loose money on the gas I would use.

My favorite serve so far, was when I went to this apartment complex one evening after work. The neighborhood was not one of our nicer neighborhoods. I knocked on the door a couple of times and finally a gentlemen yelled out the upstairs bedroom window "Who's down there".
I asked him if he was so and so, and he said ,"yes". I asked if he would come downstairs so I could talk to him. When he came downstairs. I identified myself and told him my reason for being there. He said, "Man, how do you people find me, I don't even live here, Now what I do?" I explained that I did not know what it was about, but I just deliver the documents. He read over the documents and then he politely says to me,"Well, I guess I really should'nt shoot the mesenger." and I politely responded, Thank you, I really appreciate that."

All in all most of the people I run into are pretty nice. I enjoy the work.

Hi, Jeff, I live in Harford County. I also would like to get into investigative work full time. I have been in the manufacturing field too many years and I am ready for a change. I enjoy my work but many times there is too much stress on the job. I love the challenge but I would like to take on something that is more fullfilling. I have been taking a home training course in Private Investigation. I am hoping with the Process Serving and a couple of other avenues I am checking out, that eventually I will get my foot in the door.

I am glad you enjoyed my process server experience but I have to say most of them are uneventful. Perhaps this is a good thing! The only real problem is trying to juggle my time. The light at the end of the tunnel is knowing that this problem is only temporary.

I was led to understand that the laws for each county in Texas are different when it comes to process serving. Is there another site that I might check out that lists the laws for Tarrant, Johnson, Hill, Ellis and Dallas?

I called the county clerks office about 6 weeks ago and they transferred me to two other people and noone knew anything, I was connected to an investigator's voicemail and he never returned my call. I am going to go in person. Hopefully I will get the information I need.

I've tried the link for Utah a couple times recently and keep getting the "The page cannot be displayed" message. Does anyone else have problems with this link now, or is this a problem with me/my computer?? I guess I should have added the link to my favorites last time I made it there, but I didn't. Anyone else having issues? Keep it up none the less, this is a great bunch of info you've put together.

I have been contacting various agenies on Process Servering in the Maryland area and it seems that just about every body at this time is not in need of one. Hello all,I just read the laws of Process Serving in PA and from what i gathered you have to be a sheriff.Did i miss somthing or should i just go straight to the courthouse and find out?This seems to be a very interesting field and i would really like to learn more about it. Thanks for the help.

Very informative link:cool: Yet I guess most useful to one heavily versed in "legalise" whereas and herewiths, etc., though made to speak with precision, often require much more analysis than plain speaking. For example I've read other places that CA. state requires no license for process serving unless over a certain amount served each year:p . Petra, this is true in some states, and not true in some states. You need to go to the Licensing Laws Forum, then do a search for US citizen in the Licensing Laws Only: Bounty Hunters forum, and the Licensing Laws Only: Process Servers forum.

Use the Search this forum option (on the right), not the search (in the toolbar accross the top) option. Then when you get the results. Read each one very closely. You will find your answer.

In some states you just have to be in the US with a green card (being in the US legally). I hope this helps. Someone else will be able to give you better information then I can on this subject. Good luck in all you do. ;)

Let me see if I get this right. Do you have to have license to serve process in Indiana? If I read the rule right, anyone can serve process even if they are not authorized by the court, but as witness and/or deposition. Is this so? I have tried to research this. I hope I put this in the right thread...Thanks for the to rules listing, very informative.

This is a great list of links. It will certainly be a lot of work to keep it up to date, since states change language, and locations, from time to time.

The Washington state information is accurate as of today, however, the linked information relates to process served after serving an initial summons and complaint. Generally, the summons and complaint requires personal service and that can be accomplished in different ways. Those interested should look for and study the rules before, and after, the linked rule for more detailed information.
